Terms of Service

1. Acceptance of Terms

By accessing or using ClubWatch services — including our trackers, the ClubWatch mobile app, the ClubWatch Advanced subscription, our online store, and our websites (collectively, the "Service") — you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ClubWatch provides golf club tracking technology designed to help golfers keep track of their equipment. The Service includes:

• ClubWatch trackers — Bluetooth Low Energy (BLE) sensors that screw into the grip end of your clubs and pair with the app.
• The free ClubWatch app — available for iOS and Android, which alerts you when a club is left behind. No subscription is required for core tracking.
• ClubWatch Advanced — an optional premium subscription that unlocks AI Swing Analysis, Find My Club with GPS, the Rules Official AI, a digital scorecard with GHIN posting, club analytics, automatic distance tracking, GPS course maps, and CW Social.

3. User Accounts

To use certain features you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.

4. Hardware Purchases & Warranty

ClubWatch trackers may be purchased through the ClubWatch Pro Shop at shop.clubwatch.com, subject to the pricing, shipping, and return policies presented at checkout. Trackers are intended to be installed in compatible grips; a sleeve adapter is available for SuperStroke and similar grips. Any limited hardware warranty is described at the point of sale. You are responsible for proper installation and use; ClubWatch is not responsible for damage resulting from improper installation, misuse, or modification of the trackers.

5. ClubWatch Advanced Subscription

ClubWatch Advanced is offered as a recurring subscription. Subscriptions purchased through the Apple App Store or Google Play are billed by, and managed through, those platforms and are also subject to their terms. Unless cancelled, subscriptions automatically renew at the then-current price for each billing period, and your payment method is charged at the start of each period. You can cancel at any time through your app-store account settings; cancellation takes effect at the end of the current billing period, and access to premium features ends at that time. Except where required by law or platform policy, payments are non-refundable. We may change subscription features or pricing on a prospective basis, with notice as required.

6. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Use the trackers or Service to track items or people without proper authorization
• Attempt to reverse engineer, decompile, or tamper with our hardware or software
• Use the Service in any way that could damage, disable, or impair its functionality
• Upload content that is unlawful, infringing, harassing, or that you do not have the right to share
• Misuse AI features, CW Social, or other users' data
• Violate any applicable laws or regulations

7. User Content & CW Social

You retain ownership of the content you submit — including swing videos, scores, stats, and CW Social posts. By submitting content, you grant ClubWatch a worldwide, non-exclusive, royalty-free license to host, store, process, and display that content as needed to operate and improve the Service, and to share it with other users as you direct (for example, through CW Social). You are responsible for the content you share and for respecting others' rights. We may remove content that violates these terms.

8. AI Features & Third-Party Services

AI Swing Analysis, the Rules Official AI, and similar features provide automated guidance for informational purposes only. AI output may be inaccurate or incomplete and is not a substitute for a certified golf instructor, a tournament official, or the official Rules of Golf; rulings during competition remain subject to the applicable committee and rules of the event. GPS-based features — including Find My Club, distance tracking, and course maps — depend on device location accuracy and may not always be precise. Some features rely on third-party services, such as GHIN/USGA, mapping providers, and app-store platforms, which are governed by their own terms.

9. Intellectual Property

All content, features, and functionality of ClubWatch — including text, graphics, logos, and software — are owned by ClubWatch or its licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the app for your personal, non-commercial use, subject to these terms.

10. Limitation of Liability

ClubWatch is a tool to help reduce the risk of lost clubs, but we do not guarantee that it will prevent every loss; alerts and tracking depend on Bluetooth range, device location, battery, and other factors outside our control. To the maximum extent permitted by law, ClubWatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost or damaged clubs, resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

11. Warranty Disclaimer

Except for any express limited hardware warranty provided at the point of sale, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that alerts, tracking, or analytics will be accurate or available at all times.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of ClubWatch after such modifications constitutes acceptance of the updated terms.
